1. About These Terms
These Terms & Conditions apply to your use of the water-based recreational activities and services provided by Watersports Simple.
By participating in any activity provided by Watersports Simple, you confirm that you have read, understood, and agreed to these Terms & Conditions.
Watersports Simple may update these Terms & Conditions from time to time. The version applicable at the time of your participation will apply to your activity.
2. Water Activities
Watersports Simple may provide various recreational water activities, which may include:
- Boating
- Jet Ski rides
- Speed boat rides
- Other water-based recreational activities
The availability of activities may vary depending on location, weather, water conditions, operational requirements, safety considerations, and applicable regulations.
3. Eligibility
Participants must meet any applicable age, height, weight, health, or other safety requirements for the particular activity.
Certain activities may have specific eligibility requirements. Participants must follow the instructions provided by Watersports Simple staff before and during the activity.
Children and minors may be required to participate only with a parent, guardian, or responsible adult, depending on the activity and applicable safety requirements.
Watersports Simple reserves the right to refuse participation where a person does not meet the applicable safety or eligibility requirements.
4. Safety Requirements
Safety is our highest priority.
All participants must:
- Follow the instructions of Watersports Simple staff and activity operators;
- Wear life jackets or other required safety equipment where instructed;
- Remain seated or positioned as instructed during the activity;
- Not interfere with the operation of any boat, jet ski, speed boat, or other equipment;
- Not engage in dangerous, reckless, or disruptive behaviour;
- Follow all applicable waterway and safety rules; and
- Immediately inform staff of any safety concern or emergency.
Failure to follow safety instructions may result in immediate termination of the activity without refund or compensation, where applicable.
5. Health and Fitness
Participants are responsible for determining whether they are physically and medically fit to participate in a water-based activity.
Participants should inform Watersports Simple staff of any condition or circumstance that may affect their ability to participate safely.
Participation is not recommended for anyone who is unwell, under the influence of alcohol or drugs, or otherwise unable to safely follow instructions.
Watersports Simple reserves the right to refuse participation where staff reasonably believe that participation may create a safety risk to the participant, staff, or others.
6. Alcohol and Intoxicating Substances
Participants must not operate or attempt to operate a jet ski, speed boat, boat, or other watercraft while under the influence of alcohol, drugs, or any intoxicating substance.
Watersports Simple may refuse participation to any person who appears to be under the influence of alcohol or drugs.
No refund or compensation will be due where participation is refused for safety reasons arising from intoxication.
7. Weather and Water Conditions
Water activities are subject to weather, water conditions, visibility, tides, government restrictions, and other environmental or operational factors.
Watersports Simple may delay, modify, suspend, relocate, or cancel an activity when necessary for the safety of participants, staff, or equipment.
Such decisions may be made at the discretion of Watersports Simple or its activity operators.
8. Equipment and Property
Participants must use all equipment responsibly and follow the instructions provided by Watersports Simple staff.
Participants may be held responsible, subject to applicable law, for damage to equipment, boats, jet skis, speed boats, or other property caused by their intentional or negligent actions.
Participants must not remove, tamper with, or misuse any safety equipment or other property belonging to Watersports Simple.
9. Personal Belongings
Participants are responsible for their own personal belongings.
Watersports Simple is not responsible for the loss, theft, or damage of personal belongings brought to the activity area, except where liability cannot legally be excluded.
Participants are advised not to carry valuables or unnecessary items during water activities.
10. Photography and Personal Devices
Participants should follow staff instructions regarding the use of mobile phones, cameras, selfie sticks, or other personal devices during activities.
The use of any device must not interfere with safety or the operation of the watercraft.
Watersports Simple may restrict the use of personal devices where necessary for safety reasons.
11. Participant Responsibility
Participants are responsible for following all instructions and applicable rules during their activity.
Participants must not:
- Behave in a manner that endangers themselves or others;
- Intentionally damage equipment or property;
- Interfere with staff or the operation of the activity;
- Enter restricted areas without permission;
- Engage in unlawful activities; or
- Ignore safety instructions.
Watersports Simple may immediately stop an activity or refuse further participation if a participant's behaviour creates a safety or security risk.
12. Our Responsibility
Watersports Simple takes reasonable steps to operate its activities safely and responsibly.
However, water-based recreational activities involve inherent risks, including changing weather and water conditions, movement of watercraft, falls, splashing, and other risks associated with participation.
To the extent permitted by applicable law, Watersports Simple will not be responsible for loss or damage arising from circumstances beyond its reasonable control or from a participant's failure to follow safety instructions.
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law.
13. Force Majeure
Watersports Simple will not be responsible for delays, interruptions, suspension, or cancellation of activities caused by circumstances beyond its reasonable control.
These circumstances may include adverse weather, storms, strong winds, rough water, natural disasters, accidents, equipment or mechanical issues, government restrictions, waterway closures, safety restrictions, power failures, or other unforeseen events.
14. Children and Minors
Where children or minors are permitted to participate, the parent, guardian, or responsible adult is responsible for ensuring that the minor follows all safety instructions and applicable rules.
Watersports Simple may impose additional safety requirements or restrictions for minors depending on the activity.
